Definitions 


“Biometric data” means data that is generated from imagery of the iris, retina, fingerprint, face, hand, palm, vein patterns, and voice recordings, from which an identifier template can be extracted.

“Company” Or “we” means, collectively, Memorial Gallery, Inc. d/b/a Bailey & Bailey and its affiliates - New Memorials Direct, Kin & Pebble, Memory Forge.

“Personal information” means name, e-mail address, mailing address, phone number, credit card information, biometric data, personal image or likeness or other personally identifying information provided when fulfilling your order and occasionally providing you with email offers which you may find of interest.

“You” or “your” means the individual using our website, placing an order with the Company or requesting that the Company collect the biometric data or other personal information of any of the following: (i) yourself, (ii) a living individual for whom you are the legal parent or guardian, or (iii) a deceased individual for whom you have the right to control the disposition of human remains. 

Biometric Data Collection 

The Company, its customers (“Retailers”) and licensees of its software (“Licensees”) utilize a device containing software (the “Application”) that collects biometric data for engraving jewelry, other accessories, memorials or momentos. 

By clicking “I consent” when using the Application, you acknowledge and agree that: (1) the biometric data being collected belongs to: (i) yourself, (ii) a living individual for whom you are the legal parent or guardian, or (iii) a deceased individual for whom you have the right to control the disposition of human remains; and (2) we may collect, transmit, use, share, and store your biometric data for the purposes described herein. 

Purpose of the Biometric Data Collection 

The Company uses biometric data collected through the Application to engrave images on jewelry, other accessories, memorials or momentos solely as directed by you when you place an order with the Company, a Retailer or a Licensee. 

Sharing of Biometric Data 

We will not sell, share or transfer biometric data to third parties other than among our affiliates and to web hosting partners and other reputable third parties who provide us with web services and business processes, and the Retailers or Licensees that have collected the biometric data. Any third parties that receive biometric data from the Company for the purpose of providing services and business processes to the Company are obligated to maintain the confidentiality and security of the biometric data in at least as secure of a manner as the Company. The Company will first provide notice and obtain your consent if it seeks to use your biometric data for any reason other than the purpose authorized herein. 

Requesting Information and Withdrawing Consent Regarding Biometric Data 

You may submit a request to the Company at any time for: 
  • Information regarding your biometric data, including whether we have collected, shared or sold biometric data; 
  • Access to your biometric data; · A list of all third parties and affiliates with whom we have shared or sold biometric data, including an active email address or other online mechanism with which to contact these third parties; 
  • The withdrawal of your consent to the collection or sharing of your biometric data; or 
  • The deletion of your biometric data. 
To submit a request, send an email to service@baileyandbailey.com with your name, e-mail address provided at registration, location/method of biometric data collection, approximate date of biometric data collection, and the specific request being made above, or call 253-649-0568 to provide this information. If your request is denied for any reason, you may appeal that decision by contacting service@baileyandbailey.com. You may also contact the Washington Attorney General following the instructions on its website at https://www.atg.wa.gov/file-complaint#Online. 

You acknowledge that if you revoke your consent as provided herein, we will not be able to deliver your custom jewelry and are hereby released from any obligation to perform. 

Information will be provided free of charge up to twice a year. Thereafter, any subsequent requests for information may be subject to a reasonable fee to cover administrative costs. The Company will respond promptly in accordance with the Washington My Health My Data Act. 

Biometric Data Retention Policy and Data Security Practices 

The purpose of collecting and retaining your biometric data is to enable you to order additional items engraved with images of the biometric data in the future without having to engage in any additional collection of the biometric data. 

Unless you request that your biometric data be deleted, we will continue to store your biometric data to enable you to order additional engraved items in the future due to the practical impossibility of performing another collection in most instances. 

The Company stores, transmits and protects from disclosure biometric data in a manner that is the same or more protective than the manner in which it stores, transmits and protects other Personal Information. 

Personal Information Privacy Policy 

When you place an order, you will be asked to provide certain Personal Information, including name, e-mail address, mailing address, phone number, and credit card information, for the purpose of fulfilling your order and occasionally providing you with email offers which you may find of interest. 

We DO NOT... 
  • We do not sell any of our customer information to other third-party organizations. 
  • We do not handle your financial information in a way that puts it at risk. 
The information we collect 
  • The information you provide when you place an order--including name, e-mail address, mailing address, phone number, credit card information or other information--is used solely for the purpose of fulfilling your order and occasionally providing you with email offers which you may find of interest. 
  • Like most websites, we utilize "cookies" to provide services such as recalling the items you had in your cart during your last visit. For more information about cookies and how we use them refer to the "How we use cookies" section below. 
How we protect your information 
We employ a number of security measures to keep your Personal Information safe. 
  • We keep all sensitive information inside secure networks. 
  • When you place an order, your information is transferred across the internet via a secure server that utilizes Secure Socket Layer (SSL) and encryption technology. 
  • We limit access to sensitive information to a limited number of high-confidence employees. 
How we use information 
We may use certain Personal Information we collect from you when you register, purchase products, respond to a survey or marketing communication, surf the website, or use certain other site features in the following ways: 
  • To quickly and accurately process your order. 
  • To provide you with the content and product offerings which will be most relevant to you. 
  • To effectively provide customer service to you. 
  • To provide you with special offers you may find of interest. 
Do we disclose the Personal Information we collect to outside parties? 
Except as described herein, we do not sell, trade, or otherwise transfer your Personal Information to outside parties. The term "outside parties" does not include New Memorials Direct nor does it include our web hosting partners and other reputable third parties who provide us with web services and business processes on the condition that they keep this information confidential. We may also release your information when appropriate to comply with the law or protect the rights, property and safety of our communities, our customers and ourselves.

Our site includes third-party links to other sites offering products and services you may find helpful. Each of these sites, in turn, has its own set of security and privacy policies that are beyond our control. As a result, we have no responsibility or liability for the content and administration practices of third-party sites. Should you have a negative experience with any of the sites we list, please let us know.

How we use "cookies" 
Cookies are small files that enable websites to remember information such as the items you had in your cart during your prior visit. We also use cookies to modify our site and our services so that we better meet the needs of our customers. 

No sharing of “cookies” 
At no time do we share cookie or site visitation information with any other group or organization. 

Option for alerts or to opt out 
If you wish, you can set your computer to alert you when a cookie is being sent, or you can turn cookie functions off altogether.
