Biometric Statement

By downloading and using our application, you acknowledge that we will collect, transmit, use, and store your fingerprint. The Company shall then utilize the fingerprint to engrave the jewelry. By using our scanner application, you expressly and voluntarily consent to the collection, transmission, use, and storage of your fingerprint. If the fingerprint is a minor’s, the minor’s parent or legal guardian must execute indicating that they acknowledge the collection, transmission, use, and storage of the minor’s fingerprint as provided herein, expressly and voluntarily consent to the same, and agree to release from liability and hold harmless the Retailer and Company as provided below.

Any of the above consents may be withdrawn at any time in writing sent via email to service@baileyandbailey.com. You acknowledge that if you revoke your consent as provided herein, we will not be able to deliver your custom jewelry and are hereby released from any obligation to perform.

We will not sell, share or transfer the fingerprint data to other third-party individuals or entities. Please note that we are a Washington entity. Washington law prohibits an entity from enrolling a biometric identifier, such as fingerprints, in a database for a commercial purpose when such commercial purpose (selling or disclosing to a third party for purpose of marketing of goods or services) is unrelated to the initial transaction in which a person first gains possession of the biometric identifier, without first providing notice, obtaining consent, or providing a mechanism to prevent the subsequent use of a biometric identifier for a commercial purpose. Revised Code of Washington (RCW) 19.375.010 - .020. The purpose of this transaction is for the production of custom jewelry.

Unless you request that your fingerprint(s) be deleted, we will continue to store your fingerprint. This is done for your convenience should you wish to order additional fingerprinted items in the future.

THE UNDERSIGNED DOES/DO HEREBY RELEASE FROM LIABILITY AND HOLD HARMLESS THE RETAILER AND THE COMPANY, AND THEIR OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND REPRESENTATIVES, FROM ANY AND ALL CLAIMS, DAMAGES, CAUSES OF ACTION, OR INJURIES SUFFERED AS A RESULT OF THE COLLECTION, TRANSMISSION, USE, AND STORAGE OF THE UNDERSIGNED’S FINGERPRINT, OR, IN THE CASE A MINOR’S FINGERPRINT, THE MINOR’S FINGERPRINT.

We DO NOT...
  • We do not sell any of our customer information to other third-party organizations.

  • We do not handle your financial information in a way that puts it at risk.

The information we collect

  • The information you provide when you place an order--including name, e-mail address, mailing address, phone number, credit card information or other information--is used solely for the purpose of fulfilling your order and occasionally providing you with email offers which you may find of interest.

  • Like most websites, we utilize "cookies" to provide services such as recalling the items you had in your cart during your last visit.  For more information about cookies and how we use them refer to the "How we use cookies" section below.
